By accessing, browsing, or utilizing the evrireal infrastructure—including the member access ecosystem—you acknowledge that you have read, understood, and agree to be irrevocably bound by these Terms of Service (the "Terms"). If you do not subscribe to these terms, you must immediately cease all utilization of our services.

1. Legal Capacity and Acceptance

You represent and warrant that you possess the requisite legal capacity to enter into binding contractual obligations within your jurisdiction. By initiating any transaction or enrollment in our member access subscription, you confirm that you are at least eighteen (18) years of age and that all information provided is accurate, current, and verifiable.

2. The Member Access and Subscription Billing

Your access to the member access ecosystem is predicated upon your enrollment in our recurring subscription service. You acknowledge that your initial transaction and subsequent periodic payments constitute a recurring subscription for your membership. Furthermore, you will be clearly billed and debited the sum of fourteen euros and ninety-nine cents every two weeks (14.99 €) of manner automatic and recurring. All purchases are final, subject only to the specific cancellation protocols defined in our Refund Policy, which is incorporated herein by reference.

3. Intellectual Property and Limited License

All content and systemic features provided herein are the exclusive proprietary asset of evrireal and its licensors. You are granted a strictly limited, non-transferable, and revocable license to utilize our services for non-commercial, personal objectives. Any attempt to reverse engineer, scrape, or redistribute our proprietary reservation mechanics shall be prosecuted to the maximum extent permissible under international law.

4. Liability, Disclaimers, and Limitation of Damages

The services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, evrireal expressly disclaims all warranties of any nature. Our cumulative liability to you for any controversy arising from or relating to your utilization of our services, regardless of the legal theory invoked, shall strictly not exceed the aggregate amount actually paid by you to us during the twelve (12) month period immediately preceding the triggering event.

5. Mandatory Individual Arbitration and Class Action Waiver

PLEASE READ THIS SECTION WITH UTMOST ATTENTION:

Any dispute, claim, or controversy arising out of these Terms or your use of our Services shall be resolved exclusively through binding individual arbitration. You and evrireal hereby waive the right to participate in any class action, consolidated action, or representative proceeding of any nature.

Prior to initiating arbitration, you are mandated to engage in thirty (30) days of good-faith negotiation by contacting our support apparatus at evrireal@gmail.com. The failure to attempt such resolution constitutes a material breach of these Terms.

6. Governing Law and Jurisdictional Venue

These Terms shall be interpreted and governed exclusively by the laws in force in Poland. Any litigation concerning the enforcement of an arbitration award or matters not subject to arbitration shall be submitted to the exclusive jurisdiction of the courts located in Poland. You hereby irrevocably waive any objection to the convenience of this forum.

7. Force Majeure and Operational Disruptions

evrireal shall not be held liable for any performance failure, logistical delay, or systemic disruption resulting from causes beyond our reasonable control, including, but not limited to, global supply chain volatility, governmental intervention, or technological infrastructure failures.

8. Entire Agreement

These Terms, in conjunction with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire and exclusive agreement between you and evrireal. No verbal representations or collateral understandings shall possess any legal efficacy. We reserve the unilateral right to amend these Terms at our discretion; your continued utilization of our services constitutes your binding acceptance of any such modifications.
